MUMBAI (Reuters) – SoftBank-backed Indian e-commerce firm Snapdeal has decided to pull the plug on its $152 million IPO, the company told Reuters, making it the latest casualty of a meltdown in tech stocks that has soured investor sentiment.

Snapdeal filed its initial public offering (IPO) regulatory papers for approval in December 2021, a year that saw many stock market debuts and record fund raising by Indian startups. But many are delaying IPOs amid a stock market rout that has raised concerns over frothy tech valuations.

Snapdeal, which competes with larger rivals Amazon and Walmart's Flipkart in India's booming e-commerce space, filed a request this week with the country's market regulator SEBI to withdraw its IPO prospectus, said one source with direct knowledge of the matter.

"There is no appetite for tech stocks right now," said the source, who added that SEBI has been told about the prevailing market conditions and certain other strategic decisions that contributed to the change in IPO plans.

In a statement to Reuters, Snapdeal said it has decided to withdraw the IPO prospectus "considering the prevailing market conditions", without elaborating. It adding that Snapdeal may reconsider an IPO in future depending on its need for capital and market conditions.

New Delhi-based Snapdeal was started in 2010 by Wharton alumnus Kunal Bahl and Indian Institute of Technology graduate Rohit Bansal. The company says it caters to the so-called value e-commerce segment by selling "value-for-money", or more affordable products via its shopping website and app.

Valued at $6.5 billion in 2016, Snapdeal has seen its popularity dwindle over the years as competition increased. It has recorded losses in the last three financial years between 2019 and 2021, and was hoping to raise new funds via IPO at a valuation of $1 billion.

The change of Snapdeal's plans comes as tech stocks in India that listed in recent years face investors' wrath.

Shares in Indian digital payments firm Paytm, which raised $2.5 billion in one of the country's biggest ever IPOs in November 2021, have plunged 76% since their debut.

Food delivery firm Zomato's shares have halved from their all-time highs after listing in July 2021.

In August, TPG and Prosus-funded Indian online pharmcy PharmEasy withdrew papers for its $760 million IPO, while Warburg Pincus-backed seller of wireless earphones, boAT Lifestyle, also withdrew its papers in October.

The first source added that Snapdeal's has not decided on any new timeline for when it may refile its IPO.

Snapdeal had wanted to fund organic growth initiatives with the proceeds of its IPO, which was set to include a fresh issue of shares worth 12.5 billion rupees ($152 million) and an offer for sale of 30.8 million shares.

Investors SoftBank, Sequoia Capital and Ontario Teachers' Pension Plan Board had offered to sell a part of their stakes in the IPO.

And, despite some early reluctance of national patent offices to recognize the patentability of these emerging technologies, many national patent law and patent application examination regulations have been revised in recent years to recognize their patentability. This has resulted in thousands of patents being granted worldwide for blockchain, crypto, and DeFi inventions.

A blockchain was created as a transaction ledger for the bitcoin cryptocurrency. Historically, the patent laws in most countries have deemed fintech inventions as patent ineligible business methods for lacking sufficient technical features and being merely mental processes, mathematical formulas, or methods for organizing human activity. However, a blockchain is inherently a technological system. It is a distributed ledger that consists of a growing list of electronic records that are securely linked together using cryptography and managed by a peer-to-peer computer network.

As the popularity of blockchain technology has grown and its application has expanded from the fintech sector to other industries, such as healthcare, transportation, big data, cybersecurity, and consumer electronics patent application filings for blockchain-based inventions skyrocketed worldwide. China

Due to rapid growth of crypto mining farms, e-commerce business, and fintech start-ups in China, the number of patent applications for blockchain, crypto, and DeFi inventions has exploded in recent years. Some of China’s largest e-commerce and Internet companies, such as Alibaba Group and Tencent Holdings, lead the world with thousands of granted blockchain patents.

Recognizing the importance of blockchain and fintech technologies to its economy, the Chinese government called for corporations to accelerate development of blockchain technologies in 2019. Later that year, the National Intellectual Property Administration (NIPA) in China further revised its patent examination guidelines to include examples of blockchain methods – further easing the examination process for blockchain technology applicants. Currently, there are nearly 35,000 applications and about 9,000 patents in China for blockchain, crypto, and DeFi inventions.

Europe

The European Union has traditionally been more challenging than the United States and China in its treatment of business-related inventions. The European Patent Office (EPO), according to guidelines in section G-VII, 5, deems an application patentable if its claims define a technical solution to a technical problem, and make non-obvious technical contributions over the prior art. The EPO recognizes that a blockchain is a multi-disciplinary technology and that patent applications may include claim features related to networks, computing, and communications – typically deemed “technical” – and claim features related to mathematics and business methods – typically deemed “non-technical.” Accordingly, to improve chances of obtaining a patent in Europe, applications for blockchain, crypto, or DeFi solutions should minimize their focus on non-technical features and emphasize technical aspects of the invention. To date, approximately 2000 European applications have been filed for blockchain technologies, and about 500 patents have been granted.

Japan

While business methods in Europe are not given much favor, the Japanese Patent Office (JPO) is relatively lenient for these types of applications. Despite the Japanese Patent Act following a similar framework as the EPO guidelines in terms of distinguishing technical and non-technical features, the Japanese allowance rate for business-related inventions, which umbrella blockchain-related inventions, is over 50%. This does not mean that any blockchain-related application is automatically patent eligible in Japan. For example, the data within a blockchain is unpatentable. However, a device, a method, and/or a program for implementing a process using blockchain/crypto is generally considered patent eligible by the JPO. To date, there are approximately 1700 patents in Japan for blockchain, crypto, and DeFi inventions.

South Korea

Similar to Japan and China, South Korean patent laws view blockchain-based technology quite favorably. In accordance with Article 29(1), Article 29(1)ii, and Article 29(2) of the Korean Patent Act, both blockchain core technology and application technology are patentable. Core technology covers the transmissions or transactions of data involving the use of blockchain/crypto and application technology covers the use of blockchain networks in the context of finance, security, cryptocurrencies, etc. Because both aspects of blockchain technology are deemed patent eligible, South Korea is generally a favorable country for blockchain, crypto, and DeFi patent applications. It is thus not surprising that the number of patent filings in South Korea has grown exponentially from several dozen blockchain-related patent applications in 2015 to nearly 1500 applications in 2019. 

Blockchain, crypto, and DeFi technologies provide ample opportunity for innovation as evidenced by thousands of patent applications filed worldwide for these cutting-edge technologies. The rapidly growing number of patents issued for these technologies in the United States, China, Japan, South Korea, and even Europe indicate that the majority of patent filing jurisdictions look favorably on the patentability of blockchain-based technologies. However, to maximize the chances of obtaining a patent for these technologies, inventors and their patent attorneys should be aware of different patent eligibility requirements and standards of various national patent offices and employ correct patent application drafting and prosecution strategies.

FTX collapse won’t impact everyday use of crypto in Brazil: Transfero CEO

 

The crumbling of the FTX crypto empire may have damaged Brazilian retail and institutional sentiment toward crypto. However, its impact won’t affect everyday citizens — who will still use crypto for cross-border transactions.

Reflecting on the recent fall of FTX, Thiago César, the CEO of fiat on-ramp provider Transfero Group said that the exchange’s fall, like in many countries around the world, has hurt confidence around centralized crypto exchanges and crypto in general. 

Transfero Group is tied in closely with the Brazilian crypto ecosystem and FTX as it was the fiat on-and-off-ramp provider for the exchange and is also the issuer of Brazilian Stablecoin BRZ, which was listed on the now-defunct exchange.

César told Cointelegraph that the collapse of the exchange had removed a “big liquidity source” from the market, as FTX was ranked within the top three in terms of trading volume. 

He also noted that uncertainty surrounding centralized crypto exchanges caused a “big outflow of funds” from exchanges in Brazil, with many looking into self-custody — estimating at least 20% of trading volume has been lost on exchanges so far.

“A lot of people are trying to even liquidate whatever positions they have in crypto and we just hold money in the bank account.”

César noted the FTX saga will make crypto investment a “harder sell” for new investors and traders.

“For the crypto investor/trader of course. It’s a harder sell now. If you go to a person who is not crypto savvy and you try to convince him to invest, especially in Brazil — the population has always been very skeptical of crypto. Now it’s harder,” he said. 

However, he notes that for people that use crypto as a means for cross-border payments or the “internationalization of money,” there will unlikely be any impact from the FTX collapse.

“A lot of the crypto volume in Brazil derives from players that are willing to exchange their local currency into an internationally liquid asset denominated in dollars. So in that sense, the market will not die down because crypto is just rails for that.”

In October, a report from Chainalysis found that remittance payments and battling inflation were two of the most significant drivers of crypto adoption in Latin America.

César said the FTX collapse will likely be used by local exchanges “as a lobbying tool” to push for regulations aimed at bringing international exchanges in line.

César added that these crypto exchanges had been pushing for regulation in Brazil that would “segregate” local and international exchanges by taking away international exchange’s access to their global liquidity books.

“They were proposing that regulation would enforce for example, that liquidity on the books in Brazilian reais be segregated from international books.”

César explained that such regulation would hurt international exchanges as their main advantage comes from liquid, international global books.

In a Nov. 18 report from Reuters, Roberto Dagnoni, the executive chairman and CEO of Mercado Bitcoin said crypto laws in Brazil have been “kind of dormant” during the election period but now needed priority.

“The rules that currently exist have not been applicable to some players, so they can do whatever you want,” he said.

FTX is done — What’s next for Bitcoin, altcoins and crypto in general?

 

2022 was a tough year for crypto, and November was especially hard on investors and traders alike. 

While it was incredibly painful for many, FTX’s blowup and the ensuing contagion that threatens to pull other centralized crypto exchanges down with it could be positive over the long run.

Allow me to explain.

What people learned, albeit in the hardest way possible, is that exchanges were running fractional reserve-like banks to fund their own speculative, leveraged investments in exchange for providing users with a “guaranteed” yield.

Somewhere across the crypto Twitterverse, the phrase “If you don’t know where the yield comes from, you are the yield!” is floating around.

This was true for decentralized finance (DeFi), and it’s proven true for centralized crypto exchanges and platforms, too.

Who would have known that a few ill-timed bank runs would pull down the entire house of cards by proving that while exchanges appear to have high revenue and tons of tokens on their books, many are completely unable to meet user withdrawal requests?

They took your coins and collateralized them to fund highly speculative bets.

They locked your coins in centralized DeFi platforms to earn yield, some of which they promised to share with you.

They placed user funds, along with their own reserves, into illiquid assets that were hard to convert into stablecoins, Bitcoin (BTC) and Ether (ETH) when clients and platform users wanted to access their funds.

Not your keys, not your coins.

Never has the phrase rang truer.

Let’s explore a few things that are happening in the crypto market this week.

Investors withdrew a record number of coins from exchanges to self-custody

As Cointelegraph reported earlier this week, crypto investors panic-withdrew record amounts of Bitcoin, Ether and stablecoins from exchanges.

Separate reporting cited a sharp uptick in hardware wallet sales as investors realized the importance of self-custodying their portfolios.

If the number of insolvencies and “temporarily pausing of deposits and withdrawals” messages continue to pop up over the next few weeks, it seems likely that this trend of coins leaving exchanges and popping into hardware wallets will continue.

DEXs and DeFi saw an uptick in inflows, perhaps a sign of things to come

Cointelegraph also reported on the uptick in decentralized exchange (DEX) activity and inflow to DeFi occurring concurrently with the record outflows from exchanges. After the events of the past two weeks, trust in centralized exchanges and crypto companies could be broken, and the current and next wave of crypto investors could embrace the more Web3-focused DEX and DeFi protocols.

Of course, what DeFi and DEXs need are a more transparent framework and processes that ensure user funds are safe and being used “properly.”

A steady flow of bad news could present a nice opportunity

Currently, Ether’s price looks a bit soft from a technical analysis standpoint, and the recent news about the FTX thief holding the 31st largest Ether spot position, plus concerns over censorship, centralization, the United States Office of Foreign Assets Control enforcement on this “whale” and other Ethereum-based protocols that have exposure or bankruptcy proximity to FTX and Alameda could stir up a bit of FUD that impacts the altcoin’s price action.

Uncertainty on when the Shanghai upgrade will be enacted and investor concerns about when staked coins can actually be withdrawn are also interesting conversations that could turn short-term sentiment against Ether.

The thesis is pretty simple. ETH has held support around $1,200–$1,300 pretty well through all of the previous months of bearish market developments, but will the potential challenges mentioned above lead to a test of the level again?

Stakers are essentially spot long and earning yield, so at this juncture, opening a low-level short position with taking profits orders at $700–$600 could possibly be rewarding.
